Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Black Scape LLC, trading as Mason Park, and govern your use of mason-park.com and every order you place with us — across our Early Fall Collection, Loafers, Sneakers, Sandals, Sunglasses, Belts, Watches, and our full range of Men's and Women's Tops, Bottoms, Outerwear, Footwear, Accessories, and Women's Bags.

Last updated and effective: August 25, 2026. By visiting mason-park.com or placing an order, you agree to these Terms. If you don't agree, please don't use the site.

These Terms apply to every visit to mason-park.com and every order placed through it, whether you browse as a guest or as a registered account holder. By using the site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Shipping Policy, and Return & Refund Policy, each incorporated into these Terms by reference.

Nothing in these Terms limits any statutory right you hold under the consumer protection law of the country or state in which you live — see Sections 21 through 25.

Mason Park is the trading name under which Black Scape LLC (EIN 38-4157690), 3 Germay Dr Unit 4, Wilmington, Delaware 19804, United States, designs, markets, sells, and fulfils the products listed on mason-park.com. Every reference to "we," "us," "our," or "Mason Park" in these Terms means Black Scape LLC.

mason-park.com is built and hosted on the Shopify platform, which provides our storefront, checkout, and payment infrastructure. Black Scape LLC is solely responsible for the products sold, the content published, and the decisions made under these Terms.

You must be at least 18 years old, or the age of legal majority in your jurisdiction if that is older than 18, to place an order on mason-park.com. If you are under that age, you may browse the site with the involvement of a parent or legal guardian, but any order must be placed by an adult.

By placing an order, you confirm that you have the legal capacity to enter into a binding contract and that the payment method you use belongs to you or that you are authorized to use it.

Creating a customer account is optional but lets you save addresses, view order history, and check tracking without re-entering your details. You're responsible for keeping your login credentials confidential and for all activity that happens under your account. If you believe your account has been accessed without your permission, contact support@mason-park.com immediately.

You agree to provide accurate, current information when creating an account or placing an order, and to update it if it changes. We may suspend or close an account that we reasonably believe is being used fraudulently, abusively, or in violation of Section 12.

We work hard to describe and photograph every item — from Loafers and Sneakers to Watches and Outerwear — accurately, including materials, sizing, and color. Minor variations in color can occur due to display settings and lighting, and this does not make an item defective.

All prices on mason-park.com are shown in U.S. dollars unless a different currency is displayed for your region at checkout, and do not include duties or import taxes that may apply to international orders (see Section 08 and our Shipping Policy). We reserve the right to change prices at any time, but a price change never affects an order you've already placed and paid for.

If a pricing or product description error appears on the site — for example, due to a technical or typographical mistake — we may cancel any affected order, even after confirmation, and will notify you and issue a full refund if you were charged.

Placing an order is an offer to buy, not an automatic contract. Your order confirmation email confirms we've received your order, not that we've accepted it. A contract is formed only once we send a shipping confirmation email for that item.

We may decline or cancel an order at any point before shipment, for reasons that can include product unavailability, a pricing or description error, suspected fraud or unauthorized payment use, a shipping restriction described in Section 08, or a violation of Section 12. If your payment method was already charged, we issue a full refund promptly.

All payments are processed within Shopify's PCI-DSS-compliant, SSL-encrypted checkout. Mason Park never sees or stores your full card number. We accept the following payment methods:

The badges above are stylized indicators for readability on this policy page, not the payment networks' official brand marks; the exact accepted methods and their official logos are always shown at checkout.

Your payment method is authorized and charged at the time you place your order. If we cancel your order under Section 06, we release or refund that charge promptly.

We are based in the United States and ship worldwide. Our daily order cut-off is 11:00 PM, Monday through Friday (UTC−05:00, U.S. Eastern Time); orders placed after that time, or on a weekend or holiday, begin processing the next business day. Processing takes 1 to 3 business days before your order is handed to a carrier.

Every order ships fully tracked, via USPS, FedEx, or DHL depending on your destination. Full detail, including customs and duty responsibility for international orders, PO Box and military address handling, and what happens if a package is lost or delayed, is set out in our Shipping Policy, which is part of these Terms.

You have 30 calendar days from delivery to request a return, and approved refunds are issued to your original payment method within 30 business days of approval. Condition requirements, non-returnable items, who pays return shipping, and your additional statutory rights depending on where you live are all set out in full in our Return & Refund Policy, which is part of these Terms.

If an item arrives damaged, defective, or different from what you ordered, that is never subject to a return fee or the standard condition requirements — see Section 10 of our Return & Refund Policy for how we make it right.

Discount codes and promotional offers are valid only for the dates, products, and conditions stated when they're issued, are limited to one per order unless we say otherwise, and cannot be applied retroactively to an order already placed. We may modify or end a promotion at any time without notice, which never affects an order placed while the promotion was active.

Gift cards issued by Mason Park do not expire, are not redeemable for cash except where required by law, and cannot be reloaded once fully redeemed. A lost or stolen gift card code cannot be replaced or refunded once activated.

Everything on mason-park.com — the Mason Park name and logo, product photography, written descriptions, page layouts, and site code — is owned by Black Scape LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print pages from the site for your own personal, non-commercial use in connection with shopping with us. You may not reproduce, republish, scrape, resell, or create derivative works from our site content, or use our name or trademarks, without our prior written permission.

When using mason-park.com, you agree not to:

• Use the site for any unlawful purpose, or in a way that infringes anyone else's rights.
• Attempt to gain unauthorized access to our systems, another user's account, or non-public areas of the site.
• Use bots, scrapers, or automated tools to extract data, pricing, or inventory information from the site.
• Interfere with or disrupt the site's security, integrity, or performance, including introducing malware.
• Place fraudulent orders, use a payment method you're not authorized to use, or abuse our return and refund process described in Section 09.

We may suspend access, cancel orders, or take other reasonable action against anyone who violates this section.

If you submit a product review, photo, question, or other content to mason-park.com, you confirm it's your own original work, that it doesn't infringe anyone else's rights, and that it isn't false, defamatory, or unlawful. You grant Black Scape LLC a non-exclusive, worldwide, royalty-free license to display, reproduce, and adapt that content on mason-park.com and in our marketing, with attribution where practical.

We may remove or decline to publish any submitted content at our discretion, including content that violates Section 12 or that we reasonably believe is fraudulent or misleading.

mason-park.com relies on third-party services — including Shopify for hosting and checkout, and USPS, FedEx, and DHL for delivery — and may link to other third-party websites, such as social media pages. We don't control these third parties and aren't responsible for their content, availability, or performance; your use of them is subject to their own terms and privacy policies.

mason-park.com and the products sold on it are provided "as is" and "as available." Except for the express commitments we make in these Terms and our Shipping and Return & Refund Policies, we don't make any warranty that the site will be uninterrupted, error-free, or entirely secure, or that product colors, materials, or fit will match your individual expectations beyond the description provided.

This section does not exclude or limit any statutory guarantee or warranty that cannot lawfully be excluded, including the consumer guarantees described in Sections 21 through 25.

To the fullest extent permitted by law, Black Scape LLC's total liability to you arising out of your use of mason-park.com or any order is limited to the amount you paid for the item(s) giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, such as lost profits or lost opportunities, arising from your use of the site or a delayed or lost order.

Nothing in this section limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, for fraud, or for any consumer guarantee described in Sections 21 through 25 that applies to you. Because some jurisdictions don't allow certain limitations on implied warranties or liability, some of the limitations in this section may not apply to you.

You agree to defend, indemnify, and hold Black Scape LLC harmless from any claim, loss, or expense, including reasonable legal fees, arising from your violation of these Terms, your misuse of the site, or your infringement of any third party's rights, except where the claim results from our own negligence, breach of contract, or violation of applicable consumer protection law.

Because we ship worldwide from the United States, orders are subject to U.S. export control and economic sanctions laws. By placing an order, you confirm that you are not located in, and are not ordering for delivery to, a country or region subject to comprehensive U.S. trade sanctions, and that you are not on any U.S. government restricted party list.

We may decline or cancel an order where we reasonably believe it would violate these laws, and will refund any amount already charged.

We are not liable for any delay or failure to perform our obligations under these Terms where that delay or failure results from circumstances beyond our reasonable control, including natural disasters, extreme weather, carrier network disruptions, customs delays, labor disputes, war, or governmental action. We will make reasonable efforts to notify you and resume performance once the circumstance passes.

Governing Law and Dispute Resolution

These Terms set a baseline that applies to everyone who orders from us. Depending on where you live, mandatory consumer protection law may give you additional or overriding rights — those are described in Sections 21 through 25 and are never reduced by this policy.

• Severability. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect, and the unenforceable provision will be read to reflect its original intent as closely as the law allows.
• No waiver. If we don't enforce a provision of these Terms on a given occasion, that doesn't waive our right to enforce it later.
• Assignment. You may not assign or transfer these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, without affecting your rights under them.
• Entire agreement. These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, are the entire agreement between you and Black Scape LLC regarding your use of mason-park.com, and supersede any prior agreement on the same subject.

We may update these Terms from time to time to reflect changes in our business, the tools we use, or the law. The date at the top of this page always reflects the version currently in effect, and continued use of mason-park.com after an update constitutes acceptance of the revised Terms. An order you already placed remains governed by the Terms in effect on the date you placed it. We encourage you to review this page periodically.
